Terms of Service

These terms apply to all services purchased from Manco Media. By submitting payment you agree to these terms on behalf of yourself or your organisation. The service description on the product page you purchased defines the scope of what is included, and together with these terms it forms the whole agreement between us. Any changes must be agreed in writing (email is fine).

Authorisation

You are engaging Manco Media as an independent contractor to perform the work described in the package or service you have purchased. You authorise us to access the accounts and systems needed to do that work, which may include your website hosting, WordPress admin, Google Ads, Meta Business Manager, GoHighLevel, analytics and tracking tools, and any other third party services required. Where website work is involved, you authorise write permissions to the directories and files of your hosting account and permission to install any plugins needed for maintenance and security. All accounts, access and data remain yours at all times.

Pricing and payments

All prices on this site may change without notice, though changes never apply to a subscription you have already started without us telling you first. By becoming a client you authorise Manco Media to charge your submitted payment method for all invoices generated for services rendered. Recurring fees are collected monthly in advance. If a payment fails and is not resolved within 7 days of us letting you know, we may pause work until the account is brought up to date, and we may charge interest under the Late Payment of Commercial Debts (Interest) Act 1998. To cancel a recurring payment or change payment method, contact us before your payment due date.

Your responsibilities

You agree to respond to approval requests and questions within a reasonable time, give us accurate information about your business, ensure the claims and offers you ask us to promote are truthful, legal and compliant with advertising rules, and keep your billing with any ad platforms in good standing. Where we generate leads for you, following them up promptly is your responsibility and has a major effect on results.

No guarantee of results

We apply skill, care and experience to every service, but results depend on factors outside our control, including your market, your offer, competitor activity, seasonality, your follow up of leads, and the behaviour of search engines and ad platforms. We do not guarantee any particular number of leads, cost per lead, ranking, traffic or revenue. We are not responsible for decisions made by Google, Meta or any other platform, including account suspensions, disapprovals or outages, provided these do not arise from our negligence.

Confidentiality and data protection

Each of us keeps the other's confidential information private, during and after our work together. Both parties comply with UK data protection law, including the UK GDPR and the Data Protection Act 2018. You are the controller of the personal data of your leads and customers. Where we handle that data on your behalf, for example within a CRM, we act as your processor: we process it only on your instructions, keep it secure, do not use it for any other purpose, and delete or return it when our work ends unless the law requires otherwise.

Who owns the work

Once paid for, you own the campaigns, ad copy, creative, landing pages and other deliverables we build inside your accounts. We keep ownership of our own methods, templates, tools and know how, and you have an ongoing licence to keep using anything of ours built into your deliverables.

Copyright and content

Manco Media does not assume responsibility or liability for the content of websites it manages, maintains or hosts.

Refusal of service

Manco Media reserves the right to refuse service to any individual or website containing offensive, obscene, hateful or malicious content, or for any other lawful reason.

Third party or client page modification

With a WordPress website, you may edit or update your own pages after completion unless we have agreed otherwise. If anyone other than Manco Media or its subcontractors damages the design or impairs the site's function while doing so, repair time is charged at £150 per hour beyond any time included in your maintenance plan, with a one hour minimum.

Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law. Subject to that, we are not liable for indirect losses such as lost profits, lost savings, loss of data or business interruption, and our total liability to you is capped at the fees you paid us in the three months before the issue arose. Websites and web pages are provided as is and as available, and we do not warrant that they will be uninterrupted, error free, or free from viruses, hacking or other security intrusions.

Governing law

These terms are governed by the law of Scotland, and the Scottish courts have exclusive jurisdiction over any claim or dispute relating to our services.

Service specific terms

Lead Generation Partnership

The scope of this subscription is set out in the product description at the point of purchase, covering paid lead generation including Google Ads and Meta Ads management, ad creative, landing pages, conversion tracking and CRM integration, and nurture copy. Ad spend is separate from our fee and is paid by you directly to Google and Meta using your own billing details. We are not responsible for setting up your ad platform billing or budgets unless expressly agreed. This is a rolling monthly subscription with no fixed term. Either party may cancel at any time with 30 days written notice, and email counts. On cancellation you pay for work up to the end of the notice period, we hand everything over, and we remove our access. No refunds are available for a month that has already started.

Website Maintenance and Support Plans

Cancellation requires 60 days notice. No refunds are available after your purchased package or service has started, unless otherwise authorised by Manco Media.

Search Engine Optimisation

We cannot guarantee improvements to your search engine rankings, but the pages we develop and optimise are accessible to search engines and built using our expertise to give you the best chance of ranking. Cancellation of any monthly recurring SEO service can occur at any time after 6 months from the service start date, with 60 days notice. No refunds are available after your purchased package or service has started, unless otherwise authorised by Manco Media.

Google Ads Management (standalone)

We cannot guarantee results from Google Ads, but the campaigns we set up and manage are optimised using our best practices and expertise to increase your chances of conversions. We are not responsible for setting up billing or your monthly budget on Google Ads; you accept full responsibility for setting this up correctly and paying Google on time. Cancellation of any monthly recurring service can occur at any time with 60 days notice. No refunds are available after your purchased package or service has started, unless otherwise authorised by Manco Media.
